Kevin McCarthy says Adam Schiff will ‘lie about anything’ in bid to impeach Trump


House Republican Leader Kevin McCarthy of California ripped Democrats on Thursday in reaction to their performance during the impeachment inquiry public hearings, accusing them of trying to “frame” President Trump to hurt him before the 2020 election.

“I always wondered, ‘Why does Adam Schiff lie so much?’,” McCarthy said on “The Ingraham Angle,” referring to the California Democrat who chairs the House Intelligence Committee. “He wants to impeach this president so badly. I mean, they are afraid to face him at the ballot box. So they want to frame him.”

“And that’s what they’ll continue to do, whatever it takes to impeach this president,” McCarthy added.

Earlier Thursday, McCarthy blasted Schiff as a serial liar, while House Speaker Nancy Pelosi accused President Trump of bribery — as the political war on Capitol Hill escalated, coinciding with the launch of impeachment hearings.

McCarthy continued his criticism of Schiff while talking to Ingraham, saying that it’s “all about Adam.”

“I just think Adam Schiff, he’s only focused on impeaching this president, so he’ll lie about anything to get there,” McCarthy said. “He auditions these witnesses in the basement. He’s gonna do more this weekend. He cherry-picks who can come to to the hearing. If you watch it, it’s all about Adam.”

McCarthy said he wasn’t concerned with any potential witnesses stepping forward before giving his timeline prediction for House Democrats.

“They’ll go one more week. Then we’ll go on out for Thanksgiving. Then they’ll have two more weeks and watch,” McCarthy said. “They’ll move the continuing resolution to Dec. 20. … They will vote on impeachment and then they’ll try to do USMCA [the revised trade deal with Mexico and Canada] or something.”

Kavanaugh Recalls His Confirmation at Conservative Legal Group’s Annual Gala


Leonard A. Leo, the Federalist Society’s executive vice president, has advised Mr. Trump on judicial nominations and worked on the confirmations of the two Trump appointees, Justices Kavanaugh and Gorsuch. The society itself, its website says, does not take political positions or endorse nominees.

On Thursday, Justice Kavanaugh said he had been coming to the society’s annual dinners for 25 years, adding that its work is misunderstood. “Its primary point of view,” he said of the group, “is to be open to all points of view.”

“I have always been,” he said, “a proud member of the Federalist Society.”

Justice Kavanaugh’s generally mild tone on Thursday was in sharp contrast to his heated response to accusations at his confirmation hearings last year that he had committed sexual assault in high school.

“This whole two-week effort has been a calculated and orchestrated political hit,” he said angrily at the time, “fueled with apparent pent-up anger about President Trump and the 2016 election, fear that has been unfairly stoked about my judicial record, revenge on behalf of the Clintons and millions of dollars in money from outside left-wing opposition groups.”

Justice Kavanaugh, now 54, was confirmed by a vote of 50 to 48.

On the Supreme Court bench, Justice Kavanaugh has a calm manner, asking focused questions of both sides. His written opinions have been clear, accessible and not particularly ideological. In his first term on the court, which ended in June, he was in the majority in divided cases more than any other justice.

His new colleagues have welcomed and praised him. Justice Ruth Bader Ginsburg, the senior member of the court’s liberal wing, said in June that she was pleased by his hiring practices. “Justice Kavanaugh made history by bringing on board an all-female law clerk crew,” she said. “Thanks to his selections, the court has this term, for the first time ever, more women than men serving as law clerks.”

On Thursday, Justice Kavanaugh praised all of his new colleagues. “They are patriots,” he said. “They love our court, and they love our country.”

Judges involved in shooting at Indiana White Castle suspended without pay


Three Indiana judges have been suspended without pay for their involvement in a shooting during a drunken brawl outside a White Castle restaurant in May.

The state Supreme Court said in an order published Tuesday that the county circuit judges — Andrew Adams and Bradley B. Jacobs of Clark County and Sabrina R. Bell or Crawford County — behaved in a way that was “not merely embarrassing on a personal level; they discredited the entire Indiana judiciary.”

Adams previously was sentenced to a year in jail with all but two days suspended after he pleaded guilty to battery in the incident, during which he and Jacobs suffered gunshot wounds.

An investigation by the Indiana Commission on Judicial Qualifications depicted the judges as wandering the streets of Indianapolis, where they were attending a judicial conference, in a drunken haze in the middle of the night on May 1.

The judges and a fourth man, Clark County Magistrate William Dawkins, met up at a bar where they drank for several hours before deciding to go to a strip club, which was closed, investigators said. So they then went to the White Castle.

The judges remained outside while Dawkins went inside at about 3:15 a.m., according to judicial documents. That was when two men drove by in a car and shouted something out the window, to which Bell “extended her middle finger” in response, investigators said.

The men pulled into the parking lot and got out, which led to “a heated verbal altercation … with all participants yelling, using profanity, and making dismissive, mocking, or insolent gestures toward the other group,” according to the documents.

The confrontation ended when one of the men from the car, identified as Brandon Kaiser, pulled a gun and shot Adams once and Jacobs twice, investigators said. Both men underwent emergency surgery and were hospitalized for several days.

Investigators said Adams kicked Kaiser in the back during the scuffle. That’s why he was criminally charged with battery, while Jacobs and Bell weren’t charged.

According to court documents, the investigation found that Bell was so drunk she couldn’t remember flipping off the car, but she “concedes that the security camera video shows her making this gesture.”

In her statement to detectives, Bell said she was good friends with Adams and Jacobs, whom she described as “very protective of me.”

She also told investigators that she gets “mouthy” when she drinks.

“I’m fiery and I’m feisty, but if I would have ever thought for a second that they were gonna fight or that that guy had a gun on him, I would never, never …,” Bell said, according to court documents. The quotation trails off in the original document.

All three judges were brought up on disciplinary charges, leading to this week’s order. The Supreme Court suspended Adams for 60 days and Jacobs and Bell for 30 days, all without pay. Dawkins, the magistrate, was inside the White Castle at the time of the altercation and wasn’t part of the case.

Kaiser is scheduled for trial in early January on 14 counts of aggravated battery, battery with a deadly weapon, battery, carrying an unlicensed handgun and disorderly conduct.

The other man in the car, Alfredo Vazquez, who is Kaiser’s nephew, pleaded guilty to misdemeanor battery in early November and was sentenced to 180 days of home detention and a year of probation.

South Dakota doctor made millions of dollars on unneeded, dangerous surgeries, feds say


A South Dakota neurosurgeon made millions by performing unnecessary and invasive surgeries in order to profit from medical devices in which he had a financial interest, according to a federal complaint filed Wednesday.

Dr. Wilson Asfora carried out operations using medical devices he invented and also received kickbacks from other medical companies whose devices he used, all without disclosing the arrangement to patients, the Justice Department alleged in the lawsuit, which was obtained by the Argus Leader.

Asfora allegedly implanted the devices during complex spinal surgeries which should not have been performed, authorities say, alleging that the doctor “received numerous warnings that he was performing medically unnecessary procedures – which were ‘excessive,’ ‘quite aggressive,’ and went ‘against conventional neurosurgical teaching and practice’ – with the devices in which he had a financial interest.”

The federal complaint includes warnings from Asfora’s own lawyers and warnings from medical professionals that his behavior was illegal.

Asfora worked out of two Sioux City hospitals, Sanford Medical Center and the Sioux Falls Specialty Hospital. He sold the devices to the hospitals at enormous markups, meaning he made money for the surgeries he performed as well as the devices he used.

US SUPERBUG INFECTIONS RISING, BUT DEATHS ARE FALLING 

In one case Asfora allegedly told a medical device company he could increase the number of surgeries he performed. The complaint also alleges he went to great lengths to hide his conflicts with the hospitals.

As a result, Sanford Health will be required to hire an outside auditor to monitor the health system’s billing as part of an agreement reached with the federal government. The agreement allows Sanford to continue participating in Medicare and other federal programs, despite the claims against Asfora.

Ethics panel investigating Rep. Hastings over relationship with staffer


The House Ethics Committee revealed on Thursday that it is investigating Rep. Hastings has admitted to being in a relationship with his aide, Patricia Williams, who serves as his deputy district director.

The committee is now investigating whether Hastings violated House rules with that relationship and if he received any improper gifts from that employee.

The House last year adopted a rule preventing members of Congress from having a sexual relationship with a member of their staff.

The statement said that the committee had begun an investigation on May 14, but did not reveal it publicly until Thursday.

Hastings has dismissed ethical concerns about his relationship, telling the Palm Beach Post “it’s been looking like that for 25 years” according to a story published last month.

Williams previously served as counsel to Hastings when he was accused of accepting bribes as a federal judge in the 1980s. Hastings was later impeached.

Hastings’s office didn’t immediately return a request for comment.

 

Hastings is the third lawmaker this year to be accused of running afoul of the House rule barring sexual relationships with c ongressional aides or with staffers on the committees they serve on.

 

That rule was adopted last year after the #MeToo movement.

 

 

The House Ethics Committee has also announced that it is investigating whether Guam’s delegate in Congress, Michael San Nicolas, engaged in a sexual relationship with his staffer and whether he improperly used campaign funds for personal use.

 

Hastings has drawn the scrutiny of the Ethics Committee before. 

 

A congressional staffer who worked for the U.S. Commission on Security and Cooperation in Europe filed a complaint against Hastings, who served as the commission’s chairman, alleging that he made unwanted sexual advances.

The House Ethics Committee reviewed the matter, but ultimately cleared Hastings in 2014 after finding insufficient evidence. However, the committee did find that Hastings admitted to making lewd comments in front of the complainant that showed “poor judgment.”

Ethics Committee releases messages showing Tlaib asking campaign for personal money, as ethics probes announced


The House Ethics Committee on Thursday released a trove of striking internal campaign communications sent in 2018 by Michigan Democratic Rep. Rashida Tlaib, in which Tlaib urgently requested money from her congressional campaign to defray personal expenses — and, a government watchdog said, possibly violated federal law in the process.

The document dump was related to the committee’s ongoing ethics probe into Tlaib, which the panel said on Thursday would be “expanded” based on a referral from the Office of Congressional Ethics (OCE). Additionally, the Ethics Committee acknowledged for the first time on Thursday an investigation into Florida Democratic Rep. Alcee Hastings concerning a “personal relationship with an individual employed in his congressional office.”

Texts and emails released by the Ethics Committee show Tlaib frantically contacting members of her staff for financial help.

In one April 2018 email offered as an exhibit by OCE, Tlaib wrote that she was “struggling financially right now” and was “sinking.” She continued: “So I was thinking the campaign could loan me money, but Ryan said that the committee could actually pay me. I was thinking a one time payment of $5k.”

In another email, on April 4, 2018, Tlaib wrote: “I am just not going to make it through the campaign without a stipend.”

“With the loss of a second income to lean back on,” she wrote. “I am requesting $2,000 per two weeks but not exceeding $12,000. The cost of living stipend is going towards much needed expenses due to campaigning that includes car maintenance, child care and other necessities. Please let me know if I can proceed.”

In August of that year, Tlaib texted her future chief of staff Ryan Anderson at 6:38 a.m.: “Sorry for the early text but do you think the campaign can still pay me a stipend until the general. Trying to get out of debt.”

“I think we definitely afford to do so. But we need to really clearly define your time and space,” Anderson responded, noting that the arrangement could arouse “concern” among the media.

The OCE also attached scans of numerous checks made out to Tlaib from her campaign, totalling thousands of dollars.

Talib’s lawyer said there is no evidence that she violated the law on purpose, and said there were no bad intentions.

Tlaib’s campaign committee, Rashida Tlaib for Congress, allegedly “reported campaign disbursements that may not be legitimate and verifiable campaign expenditures attributable to bona fide campaign or political purposes,” according to a release from OCE.

If Tlaib “converted campaign funds from Rashida Tlaib for Congress to personal use, or if Tlaib’s campaign committee expended funds that were not attributable to bona fide campaign or political purposes, then Tlaib may have violated House rules, standards of conduct, and federal law,” the OCE continued.

The Ethics Committee announced on August 16, 2019 that it had received a referral from the concerning Tlaib.

“The Board recommends that the Committee further review the above allegation concerning Rep. Tlaib because there is substantial reason to believe that Rep. Tlaib converted campaign funds from Rashida Tlaib for Congress to personal use or Rep. Tlaib’s campaign committee expended funds that were not attributable to bona fide campaign or political purposes,” it said.

Meanwhile, the Ethics Committee also said it was looking into an alleged relationship between Hastings and a staffer, and whether Hastings “has received any improper gifts, including any forbearance, from that employee.”

“The Committee is specifically considering whether Representative Hastings’ relationship with the individual employed in his congressional office is in violation of House Rule XXIII, clause 18(a),” the ethics panel said. That provision refers to improper sexual relationships with “any employee of the House who works under the supervision of the Member, Delegate, or Resident Commissioner, or who is an employee of a committee on which the Member, Delegate, or Resident Commissioner serves.”

“The Committee continues to gather additional information regarding the allegations,” the panel noted.

The announcement from the ethics panel came less than a month after California Democratic Rep. Katie Hill resigned amid allegations that she had improper personal relationships with her own staffers.

“I have cooperated with the Committee since May 14, 2019,” Hastings said in a statement. “As they continue to conduct their work, I stand ready to fully cooperate with their inquiry.”

The developments come amid House Democrats’ efforts to impeach President Trump. Earlier this year, Tlaib boasted that Democrats would “impeach the motherf—er,” referring to the president.

And, in a striking scene at the outset of a Rules Committee meeting last month, Hastings — who himself was impeached and removed from the federal bench in 1989 for taking bribes — outlined the alleged “high crimes and misdemeanors” that he said Trump had committed.

Castro fails to make cut as DNC announces participants for next debate


Ten candidates qualified for next week’s Democratic presidential primary debate, and former Housing and Urban Development Secretary Julián Castro is not one of them.

Castro and former Rep. Beto O’Rourke of Texas are two candidates who debated last month who will not appear on the debate stage for the next round next week. Castro failed to meet the threshold requirements set forth by Democratic National Committee Chairman Tom Perez, while O’Rourke dropped out of the race last month.

Colorado Sen. Michael Bennet, Montana Gov. Steve Bullock, former Maryland Rep. John Delaney and author Marianne Williamson also failed to qualify.

This month, candidates were required to have reached 3 percent support in at least four qualifying national polls since Sept. 13 or 5 percent in two early-nominating state polls since that date, while collecting contributions from at least 165,000 unique donors — with at least 600 each in a minimum of 20 states.

CASTRO LAYS OFF STAFF IN NEW HAMPSHIRE AND SOUTH CAROLINA

Some candidates have criticized Perez for what they’ve viewed as overly stringent requirements. Some argue that the donor emphasis has forced them to spend disproportionately for online fundraising efforts that drain resources they could be using to reach voters in other ways.

Perez says hopefuls have had ample time to demonstrate their supporter, both in polls and through small-dollar contributors, and that any Democrat falling short this far into the campaign almost certainly isn’t positioned to win the nomination or defeat President Trump in November 2020.

Perez has announced even stiffer requirements for a Dec. 19 debate. The polling marks:4 percent in four national polls or 6 percent in two early state polls taken after Oct. 16. The donor threshold: 200,000 unique donors, with at least 800 from each of 20 states.

The top-tier candidates – former Vice President Joe Biden, Massachusetts Sen. Elizabeth Warren, Vermont Sen. Bernie Sanders and South Bend, Ind., Mayor Pete Buttigieg — are not threatened by those goals. Sens. Kamala Harris of California and Amy Klobuchar of Minnesota have met them as well.

But the higher targets put pressure on several other candidates to broaden their support or risk falling out of any reasonable contention with less than three months to go before the Feb. 3 Iowa caucuses.

Two new candidates also could be vying for December spots.

Former Massachusetts Gov. Deval Patrick launched his campaign Thursday and filed to appear on New Hampshire’s first-in-the-nation primary ballot. Former New York City Mayor Michael Bloomberg is considering a bid as well, already having filed paperwork for some Super Tuesday primaries.

Next Wednesday’s debate in Atlanta will be broadcast on MSNBC, 9-11 p.m. EST.

A 16-year-old boy pulled a handgun out of his backpack at a Southern California high school Thursday morning and shot five of his fellow students, killing two, before he turned the gun on himself, police said. Los Angeles County Sheriff Alex Villanueva told reporters the suspect was in “grave condition” at a hospital.

The deceased victims were identified as a 16-year-old girl and a 14-year-old boy. The wounded victims were identified as a 15-year-old girl, a 14-year-old girl and another 14-year-old boy, and Villanueva said they were not in critical condition.

Sheriff’s Department Captain Kent Wegener said the gunman, who turned 16 Thursday, and the victims all attended Saugus High School in Santa Clarita. Police didn’t identify the gunman other than describing him as Asian; law enforcement sources told CBS News the suspected shooter has been identified as Nathaniel Berhow.

Police were not looking for any other suspects, Wegener said. A weapon was recovered from the scene.

“It’s a .45-caliber semiautomatic pistol, which had no more rounds in it, had no more bullets in it,” Wegener said. CBS Los Angeles reported that classes had not gotten underway when the shooting occurred, so the campus was not completely full.

Suspect in custody after manhunt

Police didn’t identify the gunman other than describing him as Asian; law enforcement sources told CBS News the suspected shooter has been identified as Nathaniel Berhow.

The shooting sparked a manhunt, but Villanueva said the suspect was taken to a hospital along with the victims. Wegener said the suspect shot himself in the head.

Paul Delacourt, assistant director in charge of the FBI’s field office in Los Angeles, said there was no indication of any motivation or ideology for the shooting.

Lockdown lifted at area schools

All schools in the area of the shooting went on lockdown while authorities looked for the suspect, Eric Ortiz from the sheriff’s department told KCBS-TV.

By early afternoon, all lockdowns were lifted, Mike Kuhlman, deputy superintendent for the William S. Hart Union High School District, said in a statement.

“Our hearts go out to the families”

Kuhlman said in the statement “our hearts go out to the families of those affected by this terrible incident.”

“Words are insufficient in times such as these,” he said.

“We are currently in the process of formulating a plan to care for our school and our community – and will continue sharing updates as we learn more – including the plan for the days ahead.”

A GOP senator blocked a bill for universal background checks as the Santa Clarita high-school shooting was unfolding

As news started to break about a shooting at a Santa Clarica, California, high school, the Senate was in the midst of debating legislation for universal background checks on all gun purchases that passed in the Democratic-led House earlier this year.

But a lone GOP senator squashed all consideration on behalf of Republicans, the Sacramento Bee first reported, as the shooting was unfolding halfway across the country.

Democratic Sen. Chris Murphy of Connecticut tweeted at 10:47am eastern time that he was planning to push the Senate to take up gun control legislation: “I’m about to go to the Senate floor to ask for unanimous consent to pass universal background checks.” 

He added: “Some will call me foolish for trying – one Republican objection and this fails.”

Nine minutes later, the Los Angeles County Sheriff’s Department tweeted there was a shooting underway at the Saugus High School in Santa Clarita, California.

The legislation Murphy referred to had passed the House in February. It was the first major gun control legislation passed in over two decades, which would require universal background checks for all purchases and close loopholes for sales at gun shows and online.

Senate Majority Leader Mitch McConnell, Republican of Kentucky, has refused to take it up in the upper chamber up to now.

After Murphy requested the House gun control bill be passed by unanimous consent — a roll-call vote where senators are on the record — Republican Sen. Cindy Hyde-Smith of Mississippi objected, saying more time was needed to consider and debate it.

 

“Many questions about this legislation need to be answered before it’s forced upon law-abiding gun owners,” Hyde-Smith said.

A spokesperson for Hyde-Smith told Business Insider that the Republican senator learned of the shooting in California just before noon, and that she wasn’t aware of it when she cast her objection to Murphy’s request.

But the spokesperson said the Mississippi senator stood by her decision on the Senate floor.

“Senator Hyde-Smith stands by her objection to circumventing the committee and Senate debate process on an issue as important as taking away Second Amendment right from law-abiding Americans,” the spokesperson said.

Murphy was furious over the objection, ABC News reported.

“You’re in the majority! You have the ability to pass legislation that you support, that Democrats can support as well,” Murphy said to his Republican colleagues. “And the idea that we are just going to sit here and twiddle our thumbs week after week as 100 people are killed by guns [every day]… it’s an abdication of our basic responsibility as United States senators,” he said.

Democratic Sen. Richard Blumenthal, also of Connecticut, was speaking in support of the bill shortly after when an aide handed him a note informing him of the shooting in California. 

“As I speak on the floor right now, there is a school shooting in Santa Clara, California,” Blumenthal said, misstating the Santa Clarita location. “How can we turn the other way, how can we refuse to see that shooting in real time, demanding our attention, requiring our action?”

“The unconscionable loss of life is our responsibility,” Blumenthal added.

Authorities in California say the gunman shot five students, killing two, before turning the gun on himself, the New York Times reported.  The suspect, which police have described as a 16-year-old male student, was taken into custody.
